MegaGlitch Ltd – Competition Terms and Conditions

1. The Promoter

1.1. The Promoter is MegaGlitch Ltd, a company registered in England and Wales under company number 15219798, with registered office at Glover Stanbury, 30 Bear Street, Barnstaple, Devon, EX32 7DD, United Kingdom.

1.2. The Promoter can be contacted at info@megaglitch.co.uk.

2. The Competitions

2.1. These Terms and Conditions apply to competitions operated by the Promoter through www.megaglitch.co.uk (the “Website”).

2.2. The information displayed on the relevant competition page forms part of these Terms and Conditions and may include the ticket price, maximum number of tickets, entry limits, Prize or Prizes, Instant Win Prizes, competition period and any competition-specific conditions.

2.3. MegaGlitch may operate:

(a) an Instant Win Only Competition, where Prizes are attached to predetermined Instant Win ticket numbers and there is no separate final draw; or

(b) a Draw Competition, where a Prize is awarded through a draw after the applicable Closing Date. A Draw Competition may also contain Instant Win Prizes.

2.4. Entrants may be required to correctly answer a question or solve a problem set by the Promoter (the “Competition Question”). Where a Competition Question applies, an entry will only become valid if the required correct answer is submitted.

2.5. Where both paid and free entry methods are available, valid ticket numbers obtained through either method participate in the same competition and are processed through the same prize allocation system.

2.6. Instant Win Only Competitions normally operate in rolling seven-day periods (each a “Current Period”). The countdown displayed on the competition page represents the end of the Current Period and does not necessarily represent the final closure of the competition.

If the closure conditions in clause 4.6 have not been satisfied at the end of the Current Period, the competition will automatically continue for a further seven-day Current Period. Existing ticket numbers and Prizes already won remain unaffected.

2.7. Where the applicable terms of a Draw Competition provide for a maximum of four extensions, that competition may be extended no more than four times.

2.8. The Terms and competition-specific conditions in force when an entry is made will apply to that entry.

3. Eligibility and How to Enter

3.1. Entrants must be aged 18 or over and resident in the United Kingdom unless the relevant competition page states otherwise.

A person directly involved in configuring winning numbers, selecting winners or administering the prize-allocation process for a particular competition may not enter that competition.

3.2. Online Entry

To enter online, an Entrant must:

(a) select the relevant competition;

(b) correctly answer the Competition Question where applicable;

(c) select the required number of entries;

(d) provide the required checkout information; and

(e) successfully complete payment.

3.3. Ticket Numbers

Once an online entry has been successfully processed, the Promoter’s automated competition system will allocate the applicable ticket number or ticket numbers.

Ticket numbers may be displayed on the Website and/or provided by email or order confirmation.

A guest checkout entry remains valid even where the ticket numbers do not subsequently appear within a registered customer account.

3.4. Entry Limits

The total number of tickets available and any maximum entry limit per Entrant will be stated on the relevant competition page.

An Entrant must not use multiple accounts, identities or other persons for the purpose of circumventing an individual entry limit or other restriction imposed on a competition.

3.5. Free Postal Entry

An Entrant may enter for free by post subject to the following requirements.

Each postal entry must be sent separately on an unenclosed postcard using first or second class post at the normal postal rate to:

Each postal entry must clearly and legibly contain:

(a) the competition being entered;

(b) the Entrant’s full name;

(c) postal address;

(d) telephone number;

(e) email address;

(f) the answer to the Competition Question where applicable; and

(g) confirmation that the Entrant agrees to these Terms and Conditions.

Hand-delivered entries will not be accepted.

Each postal entry must be sent separately. Multiple entries sent together or included on the same postcard will be treated as one postal entry.

The number of ticket numbers allocated for each valid postal entry will be stated on the relevant competition page.

Once allocated, free-entry ticket numbers are processed through the same prize-allocation system as paid ticket numbers and are not distinguished from paid ticket numbers when determining winners.

A Website account is not required solely to submit a postal entry.

Postal entries must be received and processed while ticket numbers remain available and before the competition finally closes. Proof of posting is not proof of receipt.

Incomplete, illegible or non-compliant postal entries may be rejected.

3.6. Temporary Ticket Reservations

Ticket numbers may be temporarily reserved while an Entrant completes checkout and payment.

A temporary reservation is not a completed entry and does not give the Entrant any right to the reserved ticket numbers unless the transaction is successfully completed.

The Promoter may release ticket numbers associated with abandoned baskets, expired checkout sessions, failed payments, cancelled orders, unpaid orders or incomplete transactions.

3.7. Ticket Holding and Reservation Abuse

Deliberately reserving, holding or blocking ticket numbers is strictly prohibited. This includes acting alone or with others, using multiple baskets, accounts, devices, payment attempts, automated tools or any other method to manipulate ticket availability, restrict other Entrants or gain an unfair advantage.

3.8. Disqualification and Ban

Where the Promoter reasonably determines that an Entrant has engaged in ticket holding, reservation abuse or deliberate manipulation under clause 3.7, all of that Entrant’s entries in the affected competition will be disqualified, any Prize will be forfeited, entry fees will not be refunded, and the Entrant may be permanently banned from MegaGlitch and future competitions.

The Promoter may also immediately release any tickets being held or reserved and close or block any associated accounts.

3.9. Technical Failures

The Promoter accepts no responsibility for an entry which is not successfully completed because of circumstances outside the Promoter’s reasonable control, including an Entrant’s device, internet connection, payment provider or other third-party service.

3.10. Refunds

Entry fees are non-refundable once payment has been accepted and ticket numbers have been allocated.

No refund will be provided because an Entrant changes their mind, does not win, fails to use or check their entry, becomes ineligible, or is disqualified for breach of these Terms.

A duplicate payment charged in error will be refunded once the duplication has been verified.

This clause applies to the fullest extent permitted by law.

4. Instant Wins, Draws and Competition Closure

4.1. Instant Win Numbers

Where a competition contains Instant Win Prizes, the winning ticket numbers are predetermined and securely configured before the relevant ticket numbers are allocated to Entrants.

Ticket numbers are allocated automatically through the Promoter’s competition system and are allocated independently of the identity of the Entrant.

4.2. Instant Checking

Ticket numbers are automatically checked against the available Instant Win numbers as soon as they are issued.

If an allocated ticket number matches an available Instant Win number, the Prize is recorded as won immediately.

4.3. Notification and Live Updates

An Instant Win result is made available immediately through the Website or entry process.

The Promoter will also send a winning notification to the email address supplied with the entry.

The Instant Win table displayed on the relevant competition page updates automatically as Instant Win Prizes are won and will show whether a Prize remains available or has been won.

A temporary technical, caching or display delay does not alter the underlying ticket allocation or the result recorded by the Promoter’s competition system.

4.4. Instant Win Only Competitions

An Instant Win Only Competition has no separate final draw.

A ticket which does not match an Instant Win number does not subsequently become eligible for another Prize unless the relevant competition page expressly provides otherwise.

4.5. Competition Records

The Promoter will maintain electronic records of ticket allocations, entries, Instant Win numbers and Prize outcomes.

The Promoter will maintain the records and independent verification required for the administration of its Instant Win promotions.

4.6. Closing an Instant Win Only Competition

An Instant Win Only Competition will not finally close merely because its Current Period reaches zero.

At the end of each Current Period, the Promoter will compare:

(a) the percentage of all available ticket numbers which have been validly allocated; and

(b) the percentage of the competition’s Instant Win Prizes which have been validly won.

The competition will only satisfy the ordinary closure condition when the percentage of Instant Win Prizes won is equal to or greater than the percentage of available ticket numbers allocated.

If the percentage of Instant Win Prizes won is lower than the percentage of tickets allocated, the competition will automatically continue for another seven-day Current Period.

For example, if 30% of available ticket numbers have been allocated but only 20% of Instant Win Prizes have been won, the competition will continue for another Current Period.

Once the percentage of Instant Win Prizes won is equal to or greater than the percentage of available ticket numbers allocated, the competition may close at the end of that Current Period.

4.7. Automatic Closure

Notwithstanding clause 4.6, an Instant Win Only Competition may close immediately if:

(a) all Instant Win Prizes have been won; or

(b) all available ticket numbers have been allocated.

The Promoter may also suspend, cancel or close a competition in the circumstances described in clause 12.1.

4.8. Draw Competitions

Where a competition contains a final draw, all valid eligible entries will be included in the applicable draw.

The winner will be selected using a verifiably random computer process or another method which satisfies the applicable promotional requirements.

The draw will normally take place within seven days of the Closing Date unless the relevant competition page states otherwise.

4.9. Live Draws

Where a competition is advertised as having a live draw, the Promoter will use reasonable efforts to broadcast that draw.

A failure or interruption affecting the broadcast does not invalidate an otherwise properly conducted and verifiable draw.

5. Competition Integrity and Disqualification

5.1. Entrants must provide accurate information and must not interfere with, manipulate or attempt to circumvent the proper operation of the Website, competition system, payment process, ticket allocation, reservation process or Prize allocation.

5.2. The Promoter may disqualify an entry or Entrant where it has reasonable grounds to believe that:

(a) false eligibility or identity information has been supplied;

(b) the Entrant has acted fraudulently;

(c) ticket or checkout systems have been deliberately manipulated;

(d) entry restrictions have deliberately been circumvented;

(e) automated systems have been used without the Promoter’s permission; or

(f) there has been another deliberate and material breach of these Terms.

5.3. The Promoter may prevent a person who has materially breached these Terms from participating in future competitions or using a MegaGlitch account.

5.4. If a winning entry is subsequently established to have been invalid, fraudulent, ineligible or obtained through deliberate manipulation, the Promoter may invalidate the winning claim and withhold or recover the Prize where legally permitted.

6. The Prize

6.1. The Prize or Prizes available in each competition are described on the relevant competition page.

6.2. Except where clause 6.10 applies, if an advertised physical Prize becomes unavailable or circumstances outside the Promoter’s reasonable control make supply of that exact Prize impracticable, the Promoter may supply an alternative of equal or greater value.

6.3. Product images are illustrative. Minor differences in colour, packaging, model revision or specification which do not materially reduce the value or nature of the Prize will not constitute a failure to provide the advertised Prize.

6.4. Where a competition page expressly advertises a cash alternative alongside a physical Prize, that cash alternative forms part of the Prize terms for that competition.

A winner has no right to demand a cash alternative unless one is expressly offered by the Promoter or provided for under these Terms.

6.5. Unless otherwise stated on the competition page, physical Prizes will be new and in good working condition when supplied.

6.6. Where a manufacturer’s warranty is supplied with or validly transferable with a Prize, the winner may have the benefit of that warranty subject to the manufacturer’s terms. MegaGlitch does not provide a separate manufacturer’s warranty.

6.7. Instant Win Prize Delivery

Following any verification reasonably required under these Terms, the Promoter will arrange dispatch or payment of an Instant Win Prize promptly.

An Instant Win Prize will be dispatched or arranged so that it is expected to be received within thirty (30) days of the winning notification.

Where delivery within that period is prevented by circumstances outside the Promoter’s reasonable control, by a third-party supplier or courier, or because the winner has failed to provide information reasonably required to release the Prize, delivery will take place as soon as reasonably practicable thereafter.

6.8. A Prize is personal to the winner and may not be transferred to another person before it has been awarded unless the Promoter agrees otherwise.

6.9. The Promoter will not arbitrarily reduce or change an advertised Prize after a competition has begun. This clause is subject to clauses 6.2 & 6.4.

 

7. Winners

7.1. Winner Notification

An Instant Win winner will normally know immediately that they have won and will also be sent an email notification.

A winner of a Draw Competition will be contacted using the details supplied with their entry.

7.2. Winner Information

The Promoter may publish or make available limited information sufficient to demonstrate that a valid award has taken place, including a winner’s surname, general location, winning ticket number and Prize won.

The Promoter may provide winner information to a competent regulator where required.

7.3. Winner Photograph or Review

Winners are required to assist MegaGlitch in demonstrating genuine Prize fulfilment.

Within fourteen (14) days after receiving the Prize, the winner must provide at least one of the following:

(a) a photograph of the winner with the Prize and, where supplied, the MegaGlitch Winner banner or placard; or

(b) an honest written review or winner testimonial concerning their experience with MegaGlitch.

The winner may choose which option to provide.

A review must represent the winner’s genuine opinion and is not required to be positive.

Winner photographs and testimonials supplied under this clause may be used by MegaGlitch on its Website, Winners Gallery and MegaGlitch social-media channels to demonstrate genuine Prize fulfilment and promote MegaGlitch.

7.4. Failure to Provide Winner Cooperation

The Promoter may send reminders where a winner has not complied with clause 7.3.

Where a winner, without reasonable explanation, fails or refuses to provide either a winner photograph or written winner review following reasonable reminders, the Promoter may treat that failure as a breach of these Terms and may restrict that person’s participation in future MegaGlitch competitions or use of a MegaGlitch account.

8. Claiming and Receiving a Prize

8.1. A Prize must normally be claimed by the winner personally.

8.2. Identity and Verification

At the Promoter’s discretion, the Promoter may require reasonable identity, age, address, payment or eligibility verification before releasing, dispatching or paying any Prize.

This may be required to prevent or investigate fraud, identity misuse, payment abuse, suspected money laundering or other financial crime, ticket or account manipulation, or breach of these Terms.

The Promoter may require:

(a) photographic identification in the form of a valid passport or driving licence;

(b) reasonable proof of the winner’s residential address; and/or

(c) evidence that a bank account nominated for payment belongs to or is jointly held by the winner.

A Prize may be withheld while reasonable verification remains outstanding.

8.3. If verification establishes that the winning entry was invalid, fraudulent, ineligible or obtained through deliberate manipulation or material breach of these Terms, the Promoter may disqualify the winning claim.

8.4. Any cash Prize or cash alternative will normally be paid into a bank account held solely or jointly in the winner’s name.

8.5. A winner must respond to a winning notification and provide information reasonably required to verify and deliver the Prize within thirty (30) days.

Where a winner fails to respond or provide the information required to release the Prize within that period despite reasonable attempts by the Promoter to contact them, the Promoter reserves the right to treat the Prize as unclaimed.

8.6. For a Draw Competition, an unclaimed or invalidated Prize may be awarded to an alternate winner selected using the same applicable winner-selection method.

9. Limitation of Liability

9.1. Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited.

9.2. Subject to clauses 9.1 and 9.4, the Promoter will not be liable for indirect, consequential or unforeseeable loss or damage, or for loss or damage arising from circumstances outside the Promoter’s reasonable control.

9.3. The Promoter will not be liable for loss of profit, revenue, business, opportunity, anticipated savings or any other business or commercial loss arising from participation in a competition or the ownership or use of a Prize.

9.4. Subject to clause 9.1 and excluding the Promoter’s obligation to provide a Prize validly won in accordance with these Terms, the Promoter’s total aggregate liability to an Entrant, however arising, in respect of or in connection with any individual paid order shall not exceed the total amount actually paid to the Promoter for that order. For the purposes of this clause, all claims arising from the same order or the same or related circumstances shall be treated as a single claim.

10. Intellectual Property and Submitted Content

10.1. Where an Entrant or winner voluntarily supplies photographs, reviews, testimonials or other material to the Promoter for publication, the Entrant confirms that they have the right to supply that material.

10.2. The Entrant grants MegaGlitch a non-exclusive, royalty-free licence to use, reproduce, publish, edit and display material supplied for the administration or promotion of MegaGlitch and its competitions.

11. Data Protection

11.1. The Promoter may process personal information where reasonably necessary to operate competitions, process entries and payments, allocate tickets, verify winners, prevent fraud and misuse, contact winners, deliver Prizes and comply with legal requirements.

11.2. Personal information may be supplied to service providers acting on behalf of the Promoter where reasonably necessary for those purposes.

11.3. Identification or proof-of-address information supplied for winner verification will be used for verification, fraud-prevention, security or compliance purposes and will not be retained for longer than reasonably necessary.

11.4. Further information about the handling of personal information is contained in the Promoter’s Privacy Policy.

12. General

12.1. Suspension, Cancellation and Amendment

The Promoter reserves the right to suspend, cancel, void, extend or amend a competition where it reasonably considers this necessary to protect the integrity or proper operation of the competition, comply with a legal or regulatory requirement, address fraud or attempted manipulation, resolve a material technical or security problem, or deal with circumstances outside the Promoter’s reasonable control.

The Promoter will not cancel a competition merely because ticket sales are lower than expected, except to the extent that clause 6.10 applies to the relevant competition.

12.2. Governing Law

These Terms and Conditions are governed by English law.

The courts of England and Wales shall have jurisdiction, subject to any mandatory jurisdictional rights which cannot lawfully be excluded.

12.3. Competition Records and Decisions

The Promoter’s transaction records, ticket-allocation records, competition-system records and Prize records will be treated as authoritative evidence of entries, ticket allocation and competition results unless they are shown to contain a clear error.

The Promoter’s decision on administrative matters relating to a competition shall be final, subject to applicable law.

12.4. Severability

If any provision or part of a provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified to the minimum extent necessary to make it valid and enforceable.

If it cannot be made valid or enforceable, it will be treated as deleted.

The invalidity or unenforceability of one provision will not affect the validity or enforceability of the remaining Terms.

12.5. Changes to These Terms

The Promoter may amend these Terms from time to time.

An entry already made will remain subject to the Terms applicable when that entry was made, except where a change becomes reasonably necessary to comply with law, correct a clear error or protect the integrity of the competition.

12.6. No Waiver

If the Promoter does not immediately exercise a right or remedy available under these Terms, this does not mean that the Promoter has waived that right or remedy.

12.7. Entire Terms

These Terms, together with the conditions displayed on the relevant competition page, constitute the rules governing entry into that competition.
